TERMS OF SERVICE

These Terms of Service govern your access to and use of the ASFAAN website and your purchase of products from ASFAAN.

The website is operated by M/S. ASFAAN, trading as ASFAAN.

By accessing this website or purchasing from ASFAAN, you agree to these Terms of Service together with the policies referenced on the website.

1. Eligibility

You must be legally capable of entering into a binding contract under applicable law to place an order through this website.

By placing an order, you confirm that the information you provide is accurate and complete.

2. Products

We make reasonable efforts to present product descriptions, fragrance information, photographs, colours, packaging and other information accurately.

The appearance of colours and materials may vary depending on lighting, photography and the device used to view the website.

Fragrance perception may vary from person to person because of factors including skin chemistry, environment and application.

Such natural variation does not by itself mean that a product is defective or incorrectly described.

3. Product Availability

Products may be produced or released in limited quantities.

Adding a product to a cart does not reserve inventory.

An order is subject to availability until it has been accepted and processed.

We may restrict quantities, withdraw products or decline an order where reasonably necessary.

4. Prices and Taxes

Prices displayed on the ASFAAN website are in Indian Rupees unless otherwise stated.

Applicable GST is included in displayed consumer prices where required.

The total amount payable will be shown before payment is completed.

ASFAAN reserves the right to correct genuine pricing or website errors.

If an error affects an order that has already been placed, we will contact the customer or cancel and refund the affected order where necessary.

5. Payment

Orders must be paid using the payment methods made available at checkout.

ASFAAN currently accepts prepaid orders only.

Cash on Delivery is not available.

Payment processing may be provided by third party payment service providers.

ASFAAN does not guarantee that every payment method will always be available.

6. Order Acceptance

An order confirmation acknowledges that we have received your order.

It does not prevent ASFAAN from cancelling an order where there is a genuine issue involving payment, stock, suspected fraud, pricing, serviceability or other legitimate operational circumstances.

If ASFAAN cancels a paid order, an appropriate refund will be initiated.

7. Cancellation

Customers may cancel an order until it has been handed over to the courier.

Once the order has been handed over for shipment, cancellation is no longer possible.

Cancellation requests should be sent to care@asfaan.com as soon as possible.

ASFAAN does not charge consumers a cancellation fee.

8. Shipping

ASFAAN currently ships only within India to serviceable PIN codes.

Orders are generally dispatched within 1 to 2 business days following payment confirmation.

Orders typically arrive within 5 to 7 business days after dispatch, although unforeseen circumstances may affect delivery.

Shipping is free on full size 50 ml fragrance bottles.

Shipping charges for Discovery Sets, where applicable, will be shown at checkout.

9. Returns, Replacements and Refunds

ASFAAN products are final sale and we do not accept returns or exchanges for change of mind, fragrance preference, incorrect selection or because a customer no longer wishes to keep the product.

This applies whether the product is opened or unopened.

This does not affect a customer's rights where a product arrives damaged, defective, leaking, missing, incorrect, materially different from its description or is otherwise eligible for a remedy under applicable law.

10. Limited Releases

Certain ASFAAN products may be produced in defined quantities.

A product being described as limited does not guarantee that it will never be produced again unless expressly stated.

ASFAAN may revise, discontinue or reintroduce products at its discretion.

11. Promotions

Promotional codes, offers and benefits are subject to their stated terms.

Unless expressly permitted, promotions cannot be combined.

ASFAAN may withdraw or correct a promotion where there has been an obvious error, misuse or technical issue.

Nothing in this section affects statutory consumer rights.

12. Intellectual Property

The ASFAAN name, wordmark, logos, product names, packaging designs, photographs, written material, website design and other original content are owned by or licensed to ASFAAN unless otherwise stated.

Content may not be copied, reproduced, distributed, commercially exploited or used to misrepresent an association with ASFAAN without permission.

13. Reviews and Customer Content

If you submit a review, image, testimonial or other content to ASFAAN, you confirm that you have the right to provide it and that it does not infringe the rights of another person.

We may display customer submitted reviews and content in connection with ASFAAN where permission has been granted or where permitted by the terms under which it was submitted.

We reserve the right to moderate unlawful, abusive, fraudulent or irrelevant submissions.

14. Prohibited Use

You must not use the website to:

1. Commit unlawful or fraudulent activity.

2. Interfere with the operation or security of the website.

3. Introduce malicious code.

4. Attempt unauthorised access to systems or information.

5. Infringe intellectual property or other legal rights.

6. Misrepresent your identity or payment information.

15. Third Party Services

The website may rely on third party services including Shopify, payment providers, shipping providers, analytics providers and communication services.

Those providers may operate under their own terms and privacy practices.

ASFAAN is not responsible for independent third party services except to the extent required under applicable law.

16. Website Availability

We aim to keep the website accurate and available but do not guarantee uninterrupted or error free access.

We may update, suspend or change parts of the website where reasonably necessary.

17. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

To the extent permitted by law, ASFAAN will not be responsible for indirect or consequential losses that were not reasonably foreseeable from the transaction.

Nothing in these Terms limits rights available to consumers under applicable Indian law.

18. Privacy

Personal information is handled in accordance with the ASFAAN Privacy Policy and applicable law.

19. Governing Law

These Terms are governed by the laws of India.

Subject to applicable consumer protection law and any jurisdiction that cannot legally be excluded, disputes relating to these Terms shall be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our operations, website, services or applicable legal requirements.

The version published on the website at the time of a transaction will apply to that transaction except where applicable law requires otherwise.
